Rainbow pub in Digbeth hit with noise order
Mr Davis said: “I haven’t physically picked it up yet but I had a phone call on Friday telling us they have reached a decision and they will serve a noise abatement order.”
Mr Kent said he was angry that although The Rainbow had promised to take the soundproofing steps, the city council would not grant a period of grace while he waits for planning permission and the building work to be carried out.
A city council spokesperson said: “A noise abatement order has been served with regards to statutory noise nuisance emanating from the Rainbow.
“This follows complaints from local residents and evidence being gained.
“Regulatory services have been working for a considerable time with the proprietors of the Rainbow in order to find a resolution. These meetings are continuing and regulatory services officers are meeting this week to help the Rainbow identify solutions.”
Mr Davis believes the noise abatement order stems from a complaint from one person living in the nearby Abacus Apartments.
“It goes back to the zealous way I think they apply this law,” he said.
“Had they spoken to them [the complainant] and said ‘we have got a commitment from The Rainbow where they will put an end to the problem but can you bear with us’ then I’m sure any reasonable person would have said fine.
“That’s what I would have expected to happen, particularly knowing what a sensitive subject this area is and the fact we have 20,000 people on the Save the Rainbow Facebook group.”
“I have got a meeting with Clive Dutton and Jacqui Kennedy from the council and I was hoping that any decision would be put off until that meeting and we could come up with a sensible solution.
“I absolutely vow to contest it, even though the scope of us raising funds to do the things they wanted to do has now been reduced.”
