Yardley diabetic jailed for road death of four year old
Clarke, 52, of Larch Walk, Yardley, who had previously been convicted of causing the death of Cory Chesielsky by dangerous driving by a jury at Birmingham Crown Court, was also banned from the roads for life.
Timothy Green, prosecuting, said the incident happened on April 13, 2006, when Cory and his 14-year-old brother Daniel had been walking on the pavement in Cartland Road, heading towards a park.
He said leading up to the accident Clarke had been driving in an erratic and dangerous way and that in Cartland Road he lost control, span and mounted the kerb.
Clarke then went through a garden wall, across a garden and collided with a house, hitting Cory who ended up underneath the vehicle. The defendant, who said he had been out making charity collections, claimed because of the attack he could remember nothing about the fatal accident.
Andrew Fisher, defending, said: “The defendant’s responsibility for the accident is directly as a result of his chronic medical condition.”
He said on the day Clarke had tried to manage his condition and continued: “Sadly that was not enough in this case because it did not prevent this tragedy. It would appear this probably happened as a result of a sudden and very rapid drop in blood sugar.”
