West Heath uncle cleared of baby murder

A “STRESSED” uncle who killed his baby niece after growing tired of her crying has been cleared of murder.

Jason Roberts shook four-month-old Aaliyah Jordan-Fellows and hurled her back into her cot, leaving her with injuries including a fractured skull.

The 24-year-old, who had been left to care for the tot at her home in Kinlet Avenue, West Heath, had already admitted her manslaughter.

But he was acquitted of murder yesterday by a jury at Birmingham Crown Court.

Roberts, of Ossmore Road, Bartley Green, was remanded in custody to allow psychiatric and pre-sentence reports to be prepared.

Judge Mrs Justice Macur said: “Roberts has a troubled past and there may be issues I must consider in reaching my decision as to what sentence should be passed.”

Aaliyah’s mother, Bobbiellen Jordan, aged 21, of Yaringale Road, Kings Heath, is due to be sentenced today after previously admitting a charge of child cruelty in relation to her daughter.

During his trial, Roberts told the court he had become “stressed and frustrated” because Aaliyah would not stop crying.

He said he had shaken her and “launched” the baby into her cot, where her head hit the side rails.

Roberts was left to care for Aaliyah when Jordan went to hospital with her boyfriend, James Nicholls, after he complained of chest pains in the early hours of December 29, 2008.

Roberts later dialled 999 and paramedics discovered Aaliyah lifeless in a bedroom.

She died two days later in the intensive care unit of Birmingham Children’s Hospital.

Christopher Hotten QC, prosecuting, said there was a “dramatic change” in Jordan’s home life when she split with Aaliyah’s father, Dean Fellows, shortly after the baby was born.

He said her relationship with Mr Nicholls, who was cleared of a charge of child cruelty following legal submissions, led to loud music being played into the early hours, cannabis being smoked and large quantities of alcohol being drunk.
